An uncontested divorce in Maine moves forward when both spouses have resolved every material issue between them, leaving the court to review and approve the agreement rather than decide disputed questions. It can arise in one of two ways: by full agreement, where both spouses agree on all issues and proceed without dispute, or by default, where the served spouse doesn’t respond to the divorce complaint within the required timeframe.
For the case to remain uncontested, the spouses must reach agreement on the division of marital assets and debts, parental rights and responsibilities (including parenting time and decision-making), child support, and spousal support if applicable. Maine uses the term “parental rights and responsibilities” in family law proceedings rather than the more commonly used phrase “child custody.” Any issue that can’t be fully resolved converts the case to a contested divorce, which typically takes longer and costs significantly more.
A judge may schedule a brief final hearing before signing the divorce decree, or may approve the agreement without requiring either party to appear. - Mandatory waiting period: Maine law requires a minimum 60-day waiting period between filing and the final hearing under Me. R. Civ. P. 113. This period can’t be waived.

- Cases involving children: A Child Support Affidavit and parenting plan are required at filing. Maine courts may also require both parents to complete a court-approved Parent Education Program.
